Terms of Service
Last updated: [[PUBLICATION_DATE]]
These terms are a contract between you and [[LEGAL_ENTITY_NAME]] ("Kyrune", "we", "us"), [[REGISTERED_ADDRESS]], [[COUNTRY_OF_ESTABLISHMENT]]. They cover kammii.ai and every page and feature served on it.
Other Kyrune sites have their own terms. If you use one of those, read the terms published there.
This page is a draft. 30 values marked in red have not been filled in yet, and until they are, this document is not the final text.
1. What Kyrune is
1.1 Kyrune is a web service for making pictures with AI image models, for talking to an AI agent that can operate those models for you, for publishing what you make to a shared feed if you choose to, for calling text models through an API, and for storing and sharing files.
1.2 The parts of the service, as they appear on kammii.ai, are:
- Image Gen, the image generator, with its model catalogue, generation settings and gallery.
- K Agent, an assistant that can change your generation settings, start generations, search the web, read web pages, run longer research, read a file you attach, and build character cards.
- Images, the public side of the site: profiles at a username, posts, comments, collections, follows and search.
- API, a programmatic interface to text models, used with a key you create in your account.
- Files, upload, storage, preview links and sharing.
- Account, sign-in, your plan, your credit balance and your settings.
1.3 One account signs you in to all of them.
1.4 We add, change and remove features. Some features are only available on some plans, and some are only available while they are in testing.
2. Who may use Kyrune
2.1 You must be at least [[MINIMUM_AGE]] years old to hold an account. If the law where you live sets a higher age for agreeing to a contract like this one or for consenting to the processing of your personal data, that higher age applies to you.
2.2 If you are under the age of majority where you live, you may only use Kyrune with the knowledge of a parent or guardian, who is then also bound by these terms.
2.3 You must be able to enter into a contract, and you must not be barred from using the service by sanctions or by any other law that applies to you or to us.
2.4 If we have closed an account of yours for breaking these terms, you may not open another one. Doing so is a breach of these terms in itself.
2.5 Kyrune is a general audience service. It is not a service for sexual content of any kind. See the Content Policy.
3. Your account
3.1 One account per person. Do not share it, do not sell it, do not transfer it, and do not let anyone else sign in with it.
3.2 You may sign in with an email address and a password, with Google, or with Discord. Whichever you use, keep it secure. Everything done with your account is treated as done by you.
3.3 Give an email address you actually control. We ask you to verify it because an account is only as trustworthy as the address behind it, and because that address is how we reach you about your own account.
3.4 Tell us promptly if you think someone else has your account.
3.5 You can sign out of every session at once from your account page.
3.6 You can delete your account. See the Privacy Policy for what deletion removes and what it does not.
4. What you make, and who owns it
4.1 You keep whatever rights you have in the images you generate, the text you write and the files you upload. We claim no ownership of them.
4.2 We make no promise that anything a model produces is original, that it is free of anyone else's rights, or that it can be protected by copyright. In several countries a purely machine-generated image is not protected by copyright at all. Whether you can register, licence or enforce rights in an output is a question about the law where you are, and it is yours to answer.
4.3 Model outputs are unpredictable. A model may ignore part of your instruction, produce something you did not want, or produce something that resembles existing work. Spending credits buys the attempt, not a particular result. See the Refunds and Cancellation Policy for the narrow cases where we return credits.
4.4 You are responsible for what you make with Kyrune and for what you then do with it. If you publish it, sell it, or put it in front of other people, that is your decision and your risk.
5. The licence you give us
5.1 To run the service at all, we need permission to handle your content. You grant us a non-exclusive, royalty-free, worldwide licence to store, copy, transmit, resize, re-encode and display your content, for as long as you keep it on Kyrune and only for the purposes in this clause.
5.2 Those purposes are: operating and delivering the service to you; generating what you asked for; showing your public posts and profile to the people you published them to; producing thumbnails, previews and other size variants; keeping backups; detecting abuse; and complying with the law.
5.3 If you publish a post or a profile publicly, you are asking us to show it to anyone who visits the page, including people who are not signed in, and to let search engines index it. Other people can then see it, share the link to it, and quote it in the ordinary way. Publishing publicly does not give other users a licence to reuse your work as their own.
5.4 You can unpublish or delete a post. After that we stop serving it. Copies other people already made are outside our control, and caches and backups take a little time to clear. See the Privacy Policy for the periods.
5.5 We do not use your prompts, your generated images or your uploads to train our own AI models, and we do not sell them to anyone else to train theirs.
5.6 We do not claim any right to use your content for advertising or promotion without asking you first.
5.7 If you send us a suggestion about the product, we may act on it without owing you anything for it. This clause is about product suggestions only. It does not touch your content.
6. What you promise about your content
6.1 You promise that you have the right to post what you post, and that posting it does not infringe anyone's copyright, trademark, privacy, publicity or other rights.
6.2 You promise that your content does not break the Content Policy, which is part of these terms.
6.3 You promise not to upload someone else's photograph, artwork or likeness and present it as yours, and not to upload a photograph of a person who has not agreed to it.
7. Rules of use
7.1 The Content Policy sets out what you may and may not make and publish here. It forms part of this contract. Read it.
7.2 In addition, do not:
- (a) break the law, or help anyone else break it;
- (b) attempt to reach an account, a file, a record or a system that is not yours;
- (c) work around a usage limit, a credit cost, a plan restriction, a filter or a safety check, including by opening extra accounts;
- (d) reverse engineer, decompile or extract the source of the service, except where a law gives you a right to do so that cannot be excluded by contract;
- (e) scrape or bulk-download the site, or automate it through anything other than an interface we publish for that purpose;
- (f) resell, rent out or sublicense access to Kyrune;
- (g) put load on the service that goes beyond ordinary use, whether deliberately or through a loop, a retry storm or a misconfigured script;
- (h) remove or obscure a copyright notice, a watermark, a credit or the generation metadata we embed;
- (i) impersonate us, or suggest we endorse you;
- (j) use the service in a way that exposes us or other users to legal risk.
7.3 We publish an API. Using it with your own key, inside its documented limits, is not a breach of clause 7.2(e). Sharing that key, or using it on behalf of people who do not have their own accounts, is.
7.4 We may set and change rate limits, quotas and credit costs. If your traffic is causing problems for other users, we may throttle it or stop it, and we will normally tell you why.
8. Plans, credits and payment
8.1 Most of what Kyrune does costs credits. Credits are the unit we meter GPU and model work in.
8.2 You get credits by buying a credit pack, by holding a monthly plan that grants credits each cycle, or from a promotion or grant we give you.
8.3 Credits are not money. They have no cash value, they cannot be redeemed for cash or for anything other than work on Kyrune, they cannot be transferred to another account, and they are not a deposit, a security, a stored-value instrument or any kind of financial product.
8.4 Credits do not expire.
8.5 Prices are shown at checkout in [[CURRENCY]] and are inclusive or exclusive of tax as stated there. [[TAX_STATUS]]
8.6 A monthly plan renews automatically until you cancel it. You can cancel at any time. Cancelling stops the next renewal and leaves the current period running to its end. Credits you have already received stay in your balance.
8.7 A plan level and a credit balance are two different things. Buying credits does not change your plan level, and a plan level on its own is not a credit balance.
8.8 If a payment fails or is reversed, we may pause the paid parts of your account until it is settled.
8.9 We may change prices and credit costs. A change never applies retroactively to a payment you have already made, and we announce a change to a recurring plan before it takes effect.
8.10 The full position on refunds, cancellations, failed generations, chargebacks and delivery is in the Refunds and Cancellation Policy, which forms part of these terms.
9. Third parties in the middle
9.1 Kyrune runs on infrastructure and services we do not own: a hosting and network provider, GPU compute providers, third-party AI model providers, payment processors and an email delivery provider. The Privacy Policy names the categories and what each one is for.
9.2 We choose these suppliers and we remain responsible to you for the service. We are not responsible for a third-party site you reach by following a link from Kyrune.
9.3 If you use the API to reach a model that a third party operates, that provider's own limits and behaviour apply to what comes back. We do not promise that a given model, version or provider remains available.
10. Moderation and enforcement
10.1 We may review, hide, restrict, remove, unpublish or refuse any content, and we may limit, suspend or close any account, where we reasonably believe these terms or the Content Policy have been broken.
10.2 We do not review content before it is published. Nothing in these terms puts us under an obligation to monitor the service, and the fact that content is visible is not our approval of it.
10.3 The ladder of enforcement, the reports channel, the appeal route and the categories that carry immediate removal are set out in the Content Policy.
10.4 Where we remove a post we normally keep the underlying record and files for a period, because an appeal and a lawful request both need the evidence. Permanent deletion is a separate, deliberate step. The periods are in the Privacy Policy.
11. Copyright complaints
11.1 If you believe something on Kyrune infringes your copyright, the notice procedure, the counter-notice procedure, our designated agent and our approach to repeat infringers are in the Copyright and Infringement Policy.
11.2 We may remove content and close accounts under that policy without any further notice under these terms.
12. Availability
12.1 Kyrune is provided as it is and as it is available. We do not promise that it will be uninterrupted, timely, error free, or fit for any purpose you have in mind.
12.2 We do not promise any particular generation speed, queue position, model availability or output quality.
12.3 We may change, suspend or discontinue any part of the service. Where a change removes something you are paying for, clause 8 and the Refunds and Cancellation Policy say what happens to your money.
12.4 Keep your own copies of anything you care about. Your gallery and prompt history live in your own browser unless you turn on cloud saving, so clearing your browser data clears them.
13. Limits on our liability
13.1 Nothing in these terms limits liability that cannot be limited by law. That includes, where it applies to you, liability for death or personal injury caused by negligence, for fraud, and rights you have as a consumer that a contract cannot take away.
13.2 Subject to clause 13.1, we are not liable for indirect or consequential loss, for lost profit, lost revenue, lost business, lost goodwill, or for the loss or corruption of data or content.
13.3 Subject to clause 13.1, our total liability to you for everything arising out of or connected with these terms is limited to the greater of the amount you paid us in the twelve months before the event complained of, or [[LIABILITY_FLOOR]].
13.4 These limits reflect that Kyrune is a low-cost service. They are part of the bargain, not an afterthought.
14. Your liability to us
14.1 If a third party brings a claim against us because of something you did on Kyrune, because of content you posted, or because you broke these terms, you will cover our reasonable losses and costs from that claim. We will tell you promptly about any such claim, let you take part in the defence, and not settle it in a way that binds you without asking you.
15. Ending the agreement
15.1 You may stop using Kyrune at any time, and you may delete your account from your account page.
15.2 We may suspend or close your account if you break these terms or the Content Policy, if we are required to by law, or if we stop offering the service. Except where the breach is serious or where the law requires immediate action, we will tell you what happened and give you a way to reply.
15.3 If we close your account for a serious breach, unspent credits are forfeited and are not refunded. If we close your account because we are discontinuing the service, or if you close it yourself, the Refunds and Cancellation Policy says what happens to unspent credits.
15.4 These clauses survive the end of this agreement: 4 (ownership), 6 (your promises), 13 (our liability), 14 (your liability), 16 (law and disputes) and any clause that by its nature is meant to outlive it.
16. Law and disputes
16.1 These terms are governed by the law of [[GOVERNING_LAW]].
16.2 Court proceedings about these terms belong in the courts of [[JURISDICTION]].
16.3 If you are a consumer in a country whose law gives you the right to bring proceedings in your own local courts, or gives you the protection of your own local consumer law, clauses 16.1 and 16.2 do not take that away from you.
16.4 [[ARBITRATION_CLAUSE]]
16.5 Before starting formal proceedings, write to us. Most problems are a misunderstanding and can be settled in an email.
17. Changes to these terms
17.1 We may change these terms. The version on this page, with the date at the top, is the one in force.
17.2 A change that materially affects you takes effect thirty days after we post it. We will tell you about it by email or by a notice in the product. Corrections, clarifications and changes required by law take effect when posted.
17.3 If you do not accept a material change, stop using Kyrune before it takes effect and, if you want, delete your account. Continuing to use Kyrune after that date means you accept it.
18. General
18.1 These terms, together with the Content Policy, the Privacy Policy, the Refunds and Cancellation Policy, the Copyright and Infringement Policy and the Cookie Policy, are the whole agreement between us about Kyrune.
18.2 If a clause is unenforceable, the rest stands and the clause is read down to the narrowest form that works.
18.3 If we do not enforce a term straight away, we have not given it up.
18.4 You may not transfer your rights under these terms. We may transfer ours to a company that takes over the service, and we will tell you if that happens.
18.5 You agree that we may communicate with you electronically, and that an email or an in-product notice satisfies any requirement for something to be in writing.
18.6 Kyrune is offered from [[COUNTRY_OF_ESTABLISHMENT]]. Some features may be unavailable where the law, a supplier, or a sanctions regime prevents us from offering them. You must not use Kyrune from a country subject to comprehensive sanctions that apply to us.
