Copyright and Infringement Policy

Last updated: [[PUBLICATION_DATE]]

This policy forms part of the Terms of Service. It is how to tell us that something published on kammii.ai infringes your rights, and how to tell us if we removed something of yours by mistake.

We take these claims seriously and we act on the ones that are properly made.

This page is a draft. 30 values marked in red have not been filled in yet, and until they are, this document is not the final text.

1. Our designated agent

Send notices to:

[[COPYRIGHT_AGENT_NAME]] [[LEGAL_ENTITY_NAME]] [[REGISTERED_ADDRESS]] Email: [[COPYRIGHT_AGENT_EMAIL]]

[[US_COPYRIGHT_AGENT_REGISTRATION]]

Email is the fastest route and the one we monitor. Please do not send a notice to the general support address: it delays it.

2. Before you send a notice

2.1 A notice under this policy is a formal legal statement. In several countries, including the United States, knowingly making a false claim of infringement exposes you to liability for the other side's losses and legal costs.

2.2 Consider first whether the use might be permitted. Criticism, commentary, parody, news reporting, quotation and research are permitted in many places, under fair use, fair dealing or a statutory exception. A use you dislike is not always an infringement.

2.3 If your complaint is that someone reproduced your face, your name or your voice rather than your work, that is a privacy or publicity complaint, not a copyright one. Use the report control in the product, or write to [[SUPPORT_EMAIL]], and see the Content Policy on real people.

2.4 If your complaint is about a Kyrune user passing off your work as theirs but no copying occurred, that is also a Content Policy matter rather than a copyright one.

2.5 If your complaint is that an AI model was trained on your work, this policy is not the route. Kyrune does not train models. Write to [[SUPPORT_EMAIL]] and tell us which model and what you believe happened, and we will pass it to the provider of that model where we can.

3. How to send a notice

Send us a written notice that contains all of the following. A notice missing any of these may not be effective and we may come back to you for it.

Write it in English if you can. If you cannot, send it in your own language and we will deal with it, but it will take longer.

4. What we do with a notice

4.1 We read every notice.

4.2 If the notice is complete and the claim is not obviously wrong, we remove or disable access to the material, normally within [[TAKEDOWN_TARGET]] of receiving it, and sooner where the matter is clear.

4.3 We tell the person who posted it what we did, why, and what the notice said, including your name and the contact details in it. If you do not want your details passed on, do not send a notice: the other side has a right to know who is complaining so that they can reply.

4.4 We tell them how to file a counter-notice.

4.5 We keep a record of the notice.

4.6 We do not decide who owns what. We are not a court. We act on properly made notices and we restore material where a properly made counter-notice goes unanswered.

5. Counter-notices

If your content was removed and you believe that was a mistake, or that you had the right to post it, you may send a counter-notice to the same address.

A counter-notice must contain all of the following.

6. What we do with a counter-notice

6.1 We send a copy of it to the person who sent the original notice, including the contact details in it, for the same reason as clause 4.3.

6.2 If they do not tell us within ten business days that they have started a court action to stop you posting the material, we may restore it. We will normally restore it between ten and fourteen business days after we pass your counter-notice on.

6.3 If they do start a court action, the material stays down and the two of you take it from there.

6.4 A false statement in a counter-notice carries the same exposure as a false statement in a notice.

7. Repeat infringers

7.1 An account that attracts repeated valid notices will lose access to Kyrune.

7.2 We do not publish a fixed number, because a number invites gaming. We look at how many valid notices there are, how serious each one is, whether they were answered by counter-notices, how much time passed, and whether the pattern looks deliberate.

7.3 We also act on a single serious case without waiting for a pattern, for example wholesale republication of someone's catalogue, or an account that exists in order to infringe.

7.4 A notice that was successfully answered by a counter-notice does not count against the account.

8. Abuse of this process

8.1 Sending notices to silence criticism, to remove a competitor, or over material you do not own is abuse of this policy.

8.2 We may decline to act on notices from a sender with a record of that, and we may tell the affected users why the material stayed up.

8.3 Both notices and counter-notices carry liability for knowingly false statements. That is not our rule, it is the law's.

9. Our own limits

9.1 We have no obligation to search Kyrune for infringement, and we do not monitor it for that purpose. Acting on a notice is not an admission that we should have found it earlier.

9.2 We are not liable for removing material in good faith under this policy, and we are not liable for declining to remove material where the notice did not meet clause 3.

9.3 A copyright dispute is between the rights holder and the person who posted. We are not a party to it and we will not adjudicate it, take sides, or provide legal advice to either of you.

9.4 We will respond to a valid court order or a lawful request from an authority.

10. Trademarks

10.1 If your complaint is about a trademark rather than a copyright, write to [[COPYRIGHT_AGENT_EMAIL]] with: your name and contact details, the mark, its registration number and the territory, the goods or services it covers, the URL of the material, and why you believe the use is likely to confuse.

10.2 We will assess it the same way. Nominative and descriptive uses, comparison, and commentary are not infringement, and we will not remove those.

11. Other rights

For a complaint about your privacy, your likeness, your personal data or your reputation, use the report control in the product, or write to [[SUPPORT_EMAIL]]. Those complaints do not need the formalities in clause 3, and they are handled under the Content Policy and the Privacy Policy.

12. Changes

We may update this policy. The version on this page, with the date at the top, is the one in force.
